K. Nugent Law is committed to protecting your privacy. This Privacy Policy applies to the law firm of K. Nugent Law, LLC, a Georgia limited liability company.

1. Categories of personal information we collect, and how we collect that information

We collect information or data about you that is “personal information,” which means information that can be used to identify you as an individual or relates to an identifiable individual. Personal information includes (but is not limited to) your name; postal addresses (such as business, home, billing, and shipping addresses); telephone number(s) (such as home, office, mobile, or otherwise); email address(es) (personal, business, or otherwise); professional experience; professional affiliations; job title and employer; or other information or data. We collect such personal information when you voluntarily choose to disclose such information to us, whether directly or indirectly through a representative.

We specifically request that you do not send to us or otherwise disclose any sensitive personal information (for example, social security numbers; information related to racial or ethnic origin; political opinions or affiliations; religion or other beliefs; health, biometrics, or genetic characteristics; criminal background; or trade union membership), through our website submission form under any circumstances, and not otherwise unless specifically requested by your attorney for or in connection with a specific purpose relating to your legal matter (e.g., we may need your SSN in connection with applying for a new corporate federal tax identification number, or your racial, ethnic, or veteran status if we are assisting you with obtaining minority-owned or veteran-owned business certification).

For example, you may disclose personal information to us when you submit information by mail, telephone, or electronically; through the software applications made available by us for use on or through computers and mobile devices; through services we provide to you directly or via our corporate or institutional clients with which you have some affiliation; through any other offline business interactions you may have with us; when you voluntarily sign up for newsletters or other marketing communications; or when you sign up to attend an event or program in person or online. These examples, and any other valid means through which we may collection your personal information for valid and legitimate purposes, are sometimes generally referred to as our “services.”

We may also collect personal information about you from another source, for example, from your employer or one of your business associates, from your representative, or from publicly available sources. If you provide personal information to us about someone else (such as one of your employees or business associates), you acknowledge that you are authorized to disclose that information to us and that, without taking any further steps, we may collect, use, store, and disclose that personal information as described in this Privacy Policy as if it were disclosed to us directly by such other person.

We also collect certain information through automatic means. For example, we may use cookies and other technologies to collect certain information when you use the www.knugentlaw.com website or other related sites linked to it (collectively, “our websites”). The information collected through our websites may include but is not limited to location, IP address, browser type, and content viewed. You can manage or disable cookies at any time by adjusting your browser settings. Browsers are different, so refer the settings menu of your browser for instructions on how to change your cookie preferences. If you choose not to receive cookies, our website may not function properly or optimally, and certain services may not be available. At this time, our website does not have the capability to respond to “Do Not Track” signals. The information provided in this paragraph is sometimes referred to as our “Cookie Policy.”

Our firm is not currently hiring or recruiting new employees or staff. If you submit personal information in an unsolicited attempt to apply to or be hired by our firm, your resume or other purported application materials may not be received, and if received, will be promptly destroyed.

We do not provide services to or direct any of our websites to children or individuals under eighteen years of age. If you are under eighteen years of age, do not use this website.

2. Why we use or process personal information

We only use your personal information for legal and legitimate interests, such as:

Legal Services: We will use and process your personal information for providing legal services; responding to your requests or inquiries, when appropriate, when you contact us via our online contact form or otherwise; promoting and marketing our legal services (including suggesting additional legal services that may be relevant to you); assisting with managing, enhancing, and improving our legal services; communicating with you about those legal services; providing administrative and billing information to you, as applicable, regarding our services; and complying with our legal and ethical obligations related to those legal services.

Marketing: We may process certain of your personal information for direct marketing based on your consent. You have the option to withdraw your consent at any time. We also may process your location data, IP address, and content viewed on our websites pursuant to our Cookie Policy. Contract performance: We may use or process personal information in connection with activities and discussion with you prior to the commencement a contract or engagement we have with you (with respect to the performance of legal services or otherwise), and to perform or otherwise fulfill a contract or engagement that we have with you (with respect to the performance of legal services or otherwise). Examples include but are not limited to validating authorized signatories; contacting or otherwise communicating with individuals (including employees of institutional clients) in connection with the performance of services; responding to client inquiries and fulfilling client requests; and managing our ongoing relationship.

Legal obligations: We will use or process personal information as necessary for compliance with a legal obligation to which we are subject. This includes using or processing personal information for defense of claims against us and satisfying any government reporting obligations and requests.

Ancillary business services: We will use or process personal information as necessary in connection with our ancillary business purposes, including but not limited to internal and third-party audits; fraud and security monitoring; data analysis; operational activities; and other legitimate business purposes.

Other legitimate interests: We will process your personal information for any of our other legitimate interests not described above. These may include analyzing use of our website or services, tailoring website and news content, setting preferences in our website or electronic mailings, improving our websites, offering and managing programs and events, fulfilling our obligations to our clients and others, and managing our client and vendor relationships.

3. How and where we disclose personal information

We will not sell, trade, or rent your personal information. When you visit our website, we do not permit third parties to collect personal information about your online activities over time or across different third-party websites. However, we do share your personal information with the following categories of third parties for the purposes described in this Privacy Policy:

  • We operate our websites from the United States of America and store the information we collect through our websites in the United States of America. We may market and provide legal services, however, in other countries throughout the world. Accordingly, we will disclose information collected through our websites, as well as other personal information, across offices and geographical boundaries, within and outside of the firm, for legal and legitimate purposes as described above.
  • We will also disclose your personal information to third-party service providers that perform services for us and who are obligated to secure the information, which may include but are not limited to our web-hosting contractors, special consultants, outsourced service providers, information technology suppliers, analytics providers, mailing providers, joint marketing or event providers, and security providers. These service providers may be located anywhere in the world. Without limiting the generality of the foregoing, our web-hosting contractors and related service providers may also collect other information (that does not, generally, constitute personally identifiable information), such as your computer type (Windows or Mac), screen resolution, operating system name and version, internet browser type, and similar such information to ensure that our web services function properly. Your IP address may be collected and logged automatically in our web host’s server log files, along with the time of the visit and the pages that were visited.
  • We may also disclose your personal information as required by a court order or any other legal or regulatory requirement, including in response to requests from public and government authorities (inside or outside your country of residence, and which may include law enforcement authorities if by valid judicial or similar order), or to protect our rights, privacy, safety or property, or that of you or others anywhere in the world.
  • We may also disclose or transfer your personal information to a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of our business, assets, or stock (including in connection with any bankruptcy or similar proceedings). Such third parties may include, by way of example and not limitation, an acquiring entity and its advisors. 

The recipients of your personal information may be located outside of the jurisdiction where you reside. The laws of these other countries may not provide the same level of protection as the laws of your home country. By providing us with personal information about yourself, you acknowledge the disclosure of such personal information to these recipients. Any processing of your personal information outside of your jurisdiction will be in accordance with this Privacy Policy.

4. Our efforts to protect personal information

We take reasonable measures to protect personal information from misuse, interference, and unauthorized loss, access, modification, or disclosure. We undertake industry standard data protection practices, including by deploying a variety of commercially available software and hardware security tools. We will take such measures with respect to your personal information using security measures that we use for personal information of others, and we will do so in compliance with all applicable data protection laws and our professional secrecy and ethical obligations. Unfortunately, despite such measures, no data transmission over the internet and no database or other depository of information can be one hundred percent secure. As a result, while we will strive to protect your personal information, we cannot and do not guarantee or warrant the security of any of your personal information. We will not be and are not liable for any use, misuse, access, or disclosure of your personal information due to errors in transmission, networks that we do not control, or unauthorized acts of third parties.

5. How long we keep personal information

We will keep your personal information until such time as we no longer expect to need to use it for any legal and legitimate purpose and otherwise in accordance with all applicable laws. At the appropriate time, we will take reasonable steps to destroy your personal information or ensure that your personal information is deidentified, except where we need to retain such information to satisfy legal and professional ethical obligations and/or record retention requirements.

6. Your rights with regard to your personal information

Except as otherwise expressly discussed in this Privacy Policy, this policy only addresses our use and disclosure of personal information we collect from you. To the extent that you disclose your personal information to third parties, including any third-party website linked from any of our websites, you are subject to the privacy customs and policies of those third parties. We encourage you to ask questions or review their privacy notices or policies before you disclose any personal information to such third parties.

Our other obligations to you as our client, if applicable, are not addressed by this Privacy Policy. Those obligations are described in our terms of engagement or otherwise arise as a result of applicable law or ethical obligations. You are not a client of this firm unless and until you have formally retained us and we have agreed to be so retained, as evidenced by your execution of our engagement letter and (in most cases) your remission of a retainer deposit.

Subject to local law, you may have certain rights regarding personal information we have collected about you. Such rights might include the right to (a) know what personal information we have collected about you, (b) know what personal information about you was disclosed to third parties, (c) update or correct such information if you believe there is an inaccuracy, (d) restrict the processing of your personal information, (e) request deletion of your personal information, (f) object to our use of your personal information, or (g) request transmission of your personal information to another data controller. We will not discriminate against you for exercising any of these rights, except that the deletion of your personal information may prevent us from providing you content, services, or other benefits that depends on the processing of your personal information.

If you would like to make a complaint about how we handled your personal information, a complaint about a breach of data protection laws, or provide any other feedback relating to your data’s privacy or security, please contact us using the contact information described above. Complaints will be investigated and the outcome of the investigation will be communicated to you after the complaint is made in accordance with legal requirements. You may also have a right in some locations to file a complaint with your local data protection authority.

Residents of certain jurisdictions may have additional rights in addition to those set forth in this Privacy Policy. If you contact us at the address above, we will comply with your request to exercise such additional rights to the extent required under applicable law.

7. Additional marketing notice

We may process additional personal information provided by you for marketing purposes, for example in correspondence relating to an event, when you let us know what legal areas you are interested in, or when you wish to be contacted by us. This may include accessibility or dietary requirements which may reveal information about your health or religious beliefs. Your personal information may also be collected when you register online to receive legal updates, or when we otherwise receive your contact details from you to receive our communications.

You can update or request, however, to have your data removed from any relationship management list(s) that we may from time to time maintain. You also will be provided with the option to unsubscribe or opt-out from receiving further marketing communications by following the instructions at the bottom of each communication. Please note that if you opt out of receiving marketing emails from us, we still may need to send you important administrative or other messages from which you cannot opt out.

8. Third-Party Services

Notwithstanding anything herein that may imply to the contrary, we expressly are not responsible for the privacy, information, security, or other policies or practices of any third parties. This includes any third party that operates any website or service to which we may link.  The inclusion of a link in connection with any of our services does not imply our endorsement of the linked site or service. In addition, we are not responsible for the information collection, use, disclosure, or security policies or practices of other organizations, including but not limited to Apple, Google, Microsoft, or any other app developer, app provider, social media platform provider, operating system provider, wireless service provider, or device manufacturer, including with respect to any personal information you disclose to other organizations through or in connection with our apps or social media (if and when applicable).

Without limiting the generality of the foregoing, we advise you that we process payments for services rendered through one or more third-party service providers (“Third-Party Service Providers”). When utilizing such third-party payment services, the personal information and data you submit will be subject to the Third-Party Service Providers’ respective privacy policies, terms of service, and other policies and practices, and not this Privacy Policy. We do not control these third-party services and will not have any liability with respect to the use thereof. The availability to you of Third-Party Service Providers for payment processing or other purposes does not constitute or imply our endorsement of or affiliation with any such entity.
